Terms of service

The rules for using Hemilake during the private beta.

Agreement

These terms are between you and the developer of Hemilake, based in Madrid, Spain ("we", "us"). They cover the Hemilake software, hosted Hemilake instances, the licence service and this website. By installing Hemilake, using a licence key or connecting an account to it, you accept them. The privacy policy explains how data is handled and is part of these terms.

Private beta

Hemilake is pilot software shared with a small group of invited testers. Features change between releases, some are experimental, and an update can break an install or a graph. Keep your own copies of anything you cannot afford to lose; your mail, calendar and files stay in the services they came from.

Your licence

We give you a personal, non-exclusive, non-transferable and revocable licence to install and run Hemilake on up to the number of devices your key allows (two by default), for your own use, while the beta lasts or until the licence ends.

Hemilake is not open source. You may not:

• share your licence key, the installer, the release files or the credentials that come with them;
• redistribute, sell, rent or sublicense Hemilake, or offer it as a service to others;
• remove or bypass the licence check, the signature checks or the install limit;
• publish material we marked as confidential, including unreleased features and documentation, without our permission.

You may read, change and run the code on your own machines to understand or fix your install, and send us what you found.

Your data and your accounts

What Hemilake reads and builds from your accounts is yours. We claim no rights over it and, except for the telemetry described in the privacy policy, we do not receive it.

You are responsible for connecting only accounts and conversations you are allowed to process this way, including any rules your employer sets for work mail, chats and files, and for the people whose messages you receive. You are also responsible for the model gateway you configure, since the text being analysed goes there.

Third-party services

Hemilake connects to services run by others, such as Google, Microsoft, Slack, Atlassian, GitHub, WhatsApp and your model provider. Your use of each one stays subject to that provider's terms, and we are not responsible for their availability, their changes or what they do with data you send them. Access to Google data is also governed by the Google API Services User Data Policy. You can revoke Hemilake's access at each provider at any time.

Acceptable use

Do not use Hemilake to:

• access accounts, mailboxes or conversations that are not yours or that you are not authorised to read;
• send spam or bulk messages, or impersonate someone;
• break the law, including data-protection and employment law, or the terms of a connected service;
• attack, overload or probe our licence service, our hosted instances or this website, except in security research we agreed with you in advance.

Actions the assistant takes

Through Hemilake, Claude Code can send mail and chat messages, create and change calendar events, and close items in your brief. It asks you to confirm before each of these. You are responsible for what you confirm, and for reviewing facts and summaries before you rely on them: they are produced by a language model and can be wrong or out of date.

Hosted instances

If we run an instance for you, we keep it running on a best-effort basis during the beta, without a service level. The key that unlocks it lives only on your devices: if you lose all of them, we cannot recover the data. We may stop, move or rebuild the underlying machines to maintain them.

Ownership

We keep all rights to Hemilake, its code, its name and this website, except the rights these terms give you. If you send us feedback or a fix, we may use it without owing you anything.

No warranty

Hemilake is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement, to the extent the law allows.

Limitation of liability

The beta is free. To the extent the law allows, we are not liable for indirect or consequential damages, lost data, lost profits, or messages and events sent from your accounts, and our total liability to you for anything related to Hemilake is limited to 100 euros. Nothing in these terms limits liability for fraud, gross negligence, wilful misconduct, or anything else that cannot be limited by law, and nothing here takes away rights you have as a consumer.

Ending the licence

You can stop at any time by uninstalling Hemilake as described in the install guide. We can end or suspend a licence when the beta ends, or earlier if you break these terms, and we will tell you by email when we can. When a licence ends, installs stop receiving updates and may stop running; your data stays on your machine for you to keep or delete.

Changes

We may update these terms as the product changes. We change the effective date above and tell licence holders by email about any change that affects them. If you keep using Hemilake after that, the new terms apply.

Governing law

These terms are governed by Spanish law. Disputes go to the courts of Madrid, unless consumer law gives you the right to go to the courts where you live.
